- Absolutely none. And the "legality" of medical marijuana depends on if you apply State or Federal law in this case. Of course conservatives are all for the Federal government running in and telling the State's what to do in this case (as opposed to "State's rights" which they trumpet only when it suits them).
- Boy, what a bunch of wrong answers. The correct answer is that no city regulates the smoking of medical marijuana--that is regulated by state law. Medical marijuana cannot be smoked anywhere where tobacco smoking is prohibited, on a school bus, in a motor vehicle while it is operated, while operating a boat, or within 1,000 feet of a school, recreation center, or youth center (unless that location is within a residence). (Cal. Health and Safety Code section 11362.79.) It is legal under California law to smoke medical marijuana any place else. It is correct, however, that this is the provision of state law, the possession of marijuana remains illegal under federal law.
